
Kansas Supreme Court shoots down lower court decision
The Kansas Supreme Court reversed a a Johnson County District Court decision that had found Senate Bill 40, which relates to emergency powers, to be “unenforceable.” Kansas Attorney General Derek Schmidt said the court’s decision brings clarity to the issue. “[Friday’s] decision provides welcome clarity that the district court erred by going out of its way to ask and then answer questions not before it about the constitutionality of SB 40,” Schmidt said.
